System
The judging system is designed to mimic the dining experience of customers, focusing on the areas that make a difference to guests.  The system ranks more than 50 individual criteria which span the entire dining experience, from booking through to service and beyond. 

 

Process
The judging process includes a consumer preference survey which is used to moderate the raw data produced by the team of judges.  Using this analysis as a guide, entrants can look at specific areas of the business where they excel and other areas that could benefit from further development.

 

Feedback
2007 saw the successful introduction of the statistical feedback process to all entrants in both the restaurant and catering sectors.  Awards participants applauded the usefulness of this business development tool and appreciated the judges assessment feedback.

Be weary - Another phone scam

In these days where telemarketers are commonplace (despite "the Do Not Call" list), we would like to bring to your attention a very dubious telemarketing offer.

We were made aware of this recently when we were contacted by an organisation who identified themselves as Clarus Communications. The "local" telemarketer informed us that as we were a business, we automatically qualify for a 40% discount on phone calls.  More importantly we would not have to change existing carriers.  That is, we would still receive the same bill with the new pricing structure. On the surface this was appealing.  However after a few minutes, the "local operator" then handed the conversation over to his "supervisor," who would authorise the activation of the discount.  The supervisor then explained the conversation would be recorded for the duration of this authorisation process. One of the questions he then asked was for confirmation of the billing address, so they could send an invoice for calls made to STD and mobiles.  It is here where it started to get suspicious as we pointed out that we'd been told by the first speaker that there would not be separate bills and no change in supplier.  Surprisingly, he did not know what to say, and the conversation ended quickly.

We contacted the R&C Vic's telecommunications supplier Oracle Telecom to ask if they'd heard of this type of scam.  They have informed us that a number of businesses have been "caught out" by these types of operations, and attempts to quickly and cheaply cancel from such scams can often be unsuccessful.

Members should be wary of such telephone offers, especially in our industry. Many operators are extremely busy and can be easily distracted, agreeing to something they would not have agreed with if they had been fully informed and devoting their full attention to it.

Please let us know if you have had any experiences like this or similar; we would like to know so we can share information with Members about other "dubious" offers in the marketplace.

 

Wages rates and Fairness test update

Many members have recently received letters from the Workplace Authority regarding the Fairness Test and their employees Workplace Agreements. Many members have received notification to pay a may be seen as excessive, and Restaurant & Catering Victoria would like to encourage those members to contact the office on 9654 5866.

As a general note, it is important that members be aware that since the introduction of the Fairness Test on May 7, 2007, it has not been possible to pay the Mon-Fri hourly wage rate as a flat rate across all days of the week.  Instead, where the employer seeks to pay a flat hourly rate of pay across all days, that rate would need to increase above the minimum to compensate the employee for the loss of penalty rates, allowances and other protected award conditions, resulting in higher flat hourly rates of pay.
 
If members are currently using the help sheet "What do I pay my employees under a WorkChoices Agreement" from December 2006, please be aware that those rates are no longer applicable.

Thierry Marx Apprentice Award -
Applications open soon

The Thierry Marx Career Development Award provides two Victorian Apprentice Chefs, employed by current financial members of Restaurant & Catering Victoria, with the opportunity to travel to France to spend one month under the tutelage of Thierry Marx - Relais Gourmands 2006 French Chef of the Year at Chateau Cordeillan-Bages, Bordeaux.

The Award aims to encourage passion in young apprentices and provide them to expose them to new culinary techniques, broaden their skill set and open their eyes to the vast array of career opportunities available to them.

Nominations for the 2008 Award will be opening in the coming weeks. So keep your eye on the website www.rcv.asn.au, and on your mail-box as application forms will be sent to all members.

A Call for Participants

The possible establishment of a National Centre of Excellence for the Tourism and Hospitality Industry.

As a part of the implementation of a National Skills Shortage Strategy for the restaurant and catering industry, Restaurant & Catering Australia is looking for views on the concept of a Centre for Excellence in Hospitality. The centre is proposed as a vehicle for recognition of the skills of individuals working in the industry.

The possible aims of a Centre of Excellence could be as follows:

  • assists in raising the standard of hospitality skills across Australia;
  • provides a focus for the industry in raising the perception of working in the tourism and hospitality industry as a highly valued and rewarding profession;
  • accredits or provides a framework for businesses who achieve a high level of practices against industry benchmarks involving service, business skills and staff training and development;
  • facilitates access to on-going industry valued and recognized professional development programs; and
  • provides an opportunity for the Australian industry to benchmark itself against overseas practices

AWA's On The Way Out

The Labor Government's 'Transition to Forward with Fairness Bill' has now passed through the last stage of the review process. Contrary to earlier reports, it appears that this bill, which will result in the removal of AWA's as an employment option, will come into operation prior to the Easter Holiday Period.

Once the bill receives Royal Assent, members will no longer be able to make AWA's with their employees.  In place of AWA's will be Interim Transitional Employment Agreements that must meet a new "No Disadvantage Test (NDT)" for it to be approved.

Restaurant & Catering Victoria is tracking the process of the bill and will release further information about the consequences of the bill in the near future.

Earth Hour - 29 March 2008 - 8pm

Climate change is the most significant threat to life on Earth. One way to slow the current rate of global warming is to get each individual to make small adjustments to the way they live.  To achieve individual change we need to demonstrate how simple and easy the changes are.

The solution, an event that gets full community involvement in a simple action that will make a difference.  WWF-Australia and Fairfax invite all Melbourne households and businesses to turn off their lights for one hour at 8:00pm on 29th March 2008 - this is Earth Hour.   

On the surface, you may think that this is not really feasible, but this concept was well accepted by the Sydney restaurant fraternity when first trialled last year.

WorkChoices officially scrapped - AWA's no longer an alternative

As you are probably aware, The Federal Government officially scrapped WorkChoices as at 28 March 2008.  This has major implications to business, especially in Agreement making.

Further to the initial "important fax" that was sent last Thursday, Members are reminded that you are no longer able to make new AWA's with employees.  Nonetheless, it is also important to remind you that if you have any signed AWA's that have NOT been lodged to submit the agreements ASAP.

As a result of the Federal Government's new legislation, businesses (in Victoria) now operate under their respective Federal Award:  That is

  • Liquor and Accommodation Industry - Restaurants - Victoria Award 1998
  • Catering - Victoria - Award 1988

In place of AWA's there will be Interim Tranistional Employment Agreements that must meet a new "No Disadvantage Test (NDT)" for it to be approved. 

 

Restaurant & Catering Victoria is currently in the process of developing an Agreement and is tracking the process of the NDT and will release further information in the near future.

ANZAC Day Public Holiday

Trading restrictions and employee entitlements

 

Members should check their liquor licence if there are any restrictions to trading.

Eve of ANZAC Day

If your licence normally permits trading past midnight, but your licence has a condition that excludes trading the morning of ANZAC Day, you must close at midnight.

If your licence permits trading past midnight and does not have a condition excluding trading into the morning of ANZAC Day, you close as per usual. If your licence does not permit trading beyond midnight, then you also close as per usual.

ANZAC Day

Normal trading hours for ANZAC Day begin at 12 noon. Temporary permission to open prior to this will not be approved unless the early trading relates to the observance of ANZAC Day.

StreetSmart Results

 

Vic diners & restaurants support homeless

StreetSmart announces $224,000 in grants

Almost a quarter of a million dollars in grants will be distributed to projects and organisations assisting Australia's homeless, Streetsmart announced today.

StreetSmart CEO, Adam Robinson, said 185 restaurants and cafes in Victoria, NSW and, for the first time, Queensland and ACT, raised more than $224,000 during its recent six-week campaign, the largest fundraising result since StreetSmart began in 2003.

A special mention goes to Il Solito Posto in Melbourne's CBD as they are the 2007 Victorian Champion restaurant, raising $6000.

  • a Jobseeker registered with a Job Network Provider; or
  • simply an enthusiastic person eager for a new role in the hospitality industry.

Each candidate has a basic uniform and tool kit. For kitchen staff that is a chef uniform and knifes, front of house candidates have a white shirt, pants, apron and waiters friend.

Our candidates are either seeking work in a range of kitchen or front of house roles from kitchen hand and food preparation or cooking roles to waiting and customer service roles.

Late Entry Restrictions in Inner Melbourne
Restrictions Commence 3 June

The State Government and the Director of Liquor Licensing have implemented a 3 month trial that will prevent licensees from allowing patrons to enter their venues after 2am.  The effect of the restriction is that people who are already in the venue by 2am can stay in the venue until it shuts but no new patrons can enter. 

The restrictions will commence on the 3rd of June 2008 which means patrons out on Monday the 2nd June will be able remain in a venue until closing but will not be able to enter a venue after  2am.

During the 3 month trial late entry restriction will only apply in the local government areas Port Phillip, Stonnington, Melbourne (including Docklands) and Yarra. In addition to specific premises in Warrnambool, Ballarat, Bendigo and Traralgon.

The late entry restriction will apply to all on-premises and general licenses within the relevant area.  This means that all pubs, bars and nightclubs will be affected.  An exemption has been granted to restaurants, the floor of Crown Casino and club licenses such as RSLs.

Licensees who breach the late entry restriction by allowing people into their venues after 2am will face fines of up to $6800.

If your restaurant does not have restaurant conditions on your licence but wish to trade as a restaurant and allow new patrons to enter after 2amyou will be required to vary your licence to include restaurant conditions. You must apply to the Director of Licensing to add restaurant conditions.  The advertising period for this license change has been reduced from 28 days to 14 days to allow for any applications to be considered before or during the 3 month lockout.

Around 440 venues are directly affected by this trail.

Freeze on the Issuing of Late Night Licenses in
Inner Melbourne

The Minister for Consumer Affairs will not grant any new late-night (post 1am) licences for 12 months from the 2 May 2008 in the local council areas of Port Phillip, Stonnington, Melbourne (including Docklands) and Yarra.

The Freeze is a temporary measure allowing the Government time to take action that will be more effective in the long-term.

State Budget -
Business Tax Reform & Tourism Funding welcomed

Tourism marketing and infrastructure development are winners from this weeks budget. The $35.1 million package to boost Victoria's profile in interstate and international markets is welcomed by the tourism and hospitality sector.

When the Association was asked for an industry comment, Todd responded that "This is a favourable budget for both small business and state tourism, however funding for tourism has fallen significantly from last year"

"Investment in tourism marketing will clearly benefit the hospitality sector, especially the $13.3 million for destination marketing of regional Victoria" he said.

Key international markets will be targeted with $8 million to promote Victoria as a great place to visit as well as attracting additional air services to Melbourne. The business events sector will also benefit with $13.8 million to enhance Victoria's credentials as a world-class business events destination.

Restaurant & Catering Victoria welcomes other key budget announcements including reductions in a range of business taxes and charges:

Stamp Duty tax brackets have been adjusted on business property purchase the value of property transferred Duty paid from 1 July 2008.

  • Up to $25 0001.4% of the value of the property
  • $25 001 - $130 000$350 plus 2.4% of the value in excess of $25 000
  • $130 001 - $960 000$2 870 plus 6% of the value in excess of $130 000
  • $960 001 and over5.5% of the value of the property

Payroll Tax will fall from 5.05% to 4.95%, this will commence from 1 July 2008 and Work Cover premium will also fall to 1.387 % of an employer's payroll.

Other state government spending has been announced in the area of business skills investment ($94 million)

Thierry Marx Career Development Award
Finalists Announced

Six young Victorian apprentice chefs have been announced as finalists in the 2008 Thierry Marx Career Development Award. This year has seen over double the number of entrants following the success of the 2007 inaugural event.

Entrants were received from across regional Victoria and Melbourne restaurants and caterers.  The competition, now in its second year, is offering two Victorian cookery apprentices the chance to spend a month in France working with Thierry Marx - the 2006 Relais Gourmands French Chef of the Year.

2008 Thierry Marx Career Development Award finalists include:

  • Petros Dellidis - The Press Club, Melbourne
  • Ryan Spurrell - Vue de Monde, Melbourne
  • Adrian Smith - Gingerboy, Melbourne
  • Kate Niewenhuizen- Pettavel Winery and Restaurant, Waurn Ponds
  • Natalie Watkins - Waddingtons at Kergunyah, Kergunyah
  • Robert Tucker - Emeu Inn Restaurant, Heathcote

As part of the judging process, finalists can now expect a workplace visit from the judging panel who, will interview and observe their performance under the normal rigors of their daily working conditions. Finalists will be assessed and scored on areas including motivation, attitude, presentation and teamwork.

The two winners will be named on May 28 at a luncheon at the Brassiere by Philippe Mouchel. The winners will travel to France in early August for a month to work at Thierry Marx's Chateau Cordeillan-Bages in Bordeaux.

Applause for the 2008/9 Budget

The Restaurant & Catering Association applauds the Government on a budget that carefully balances the need for fiscal restraint with the need to maintain spending in areas that support jobs - hospitality services.  R&C Vic supports the RCA's stance that to further dampen demand (through spending cuts) would have been dangerous in an economy supported by services.

R&CA President, Con Castrisos said that 'now that the services economy supports 82% of employment in Australia, deep slashing budgets are too dangerous an instrument. As the Government has achieved in this budget, careful management is the key to keeping the Australian economy strong'.

The Association expressed its support for the closing of the loop-hole that allows for FBT free meals for big business.

In contrast the Association expressed concern over the lack of inclusion of service businesses in the Climate Change initiative. R&CA CEO John Hart suggested that 'every business needs to do its bit if we are to reduce omissions.' 'It is disappointing that some sectors will receive help to do this and others will not.'

The Association was very pleased to see the realisation of commitments to training and immigration places that will ease labour and skills constraints in the hospitality industry.

NDT leads to 25% Casual Loading for
ITEA's and Collective Agreements

In late April the Workplace Authority released their NDT Policy Guide. Following recent confirmation from the Workplace Authority, Restaurant & Catering Victoria wishes to advise you that under the NDT, employees employed under an ITEA or Employee Collective Agreement will need to be provided with sufficient compensation to cover the 25% casual loading of the Federal Awards.

Restaurant & Catering Victoria has now revised it's templates to include a 25% Casual Loading, rather than the Standard 20% loading that applied under the Fairness Test.

Please note that Workplace Agreements approved and lodged under the Fairness Test will not be impacted by this news.

Results of Live Music Survey

Recently, APRA and the Music Council of Australia (MCA) conducted a survey to find out what venue operators currently think about live music.

Sixty nine hotels, clubs and restaurants responded to the survey which was distributed through the various industry associations. The largest group of respondents were Clubs (49%) followed by Restaurants (27%) and Hotels (24%).

Over 70% of respondents said they present live music in some format in their venues throughout the year. Of these, 44% presented at least three live performances a week. 17% presented less than 10 performances a year and about 7% presented more than four a week.

Venues that did host live music were re enthusiastic about the benefits of providing live music. The benefits cited most frequently included:

  • more traffic, 
  • a more enjoyable ambience/atmosphere in the venue,
  • drawing new clientele,
  • music providing a critical point of difference in a competitive market-place,
  • creation of customer loyalty and return business
  • contributing to the cultural life of the community, and
  • supporting local talent.

Venues that didn't host live music (29% of respondents) said that the key obstacles were overhead costs, government regulations, noise regulations and concerns about security. They also cited difficulties with sourcing artists and promoting gigs and were concerned about generating support from patrons and about ensuring a decent return on investment.

When asked what would make it easier to host live music, they said simpler regulation (46%) would be helpful, along with more encouragement from Government. Just over 41% agreed that a guide to hosting live music would be welcome, along with more education on the topic generally for venue owners.

Don't be a Tosser - Bin your Butts Campaign
A success

July 1 marks the first year anniversary of the Victorian Government's legislation to make enclosed licensed premises smoke-free and Sustainability Victoria's 'Don't be a Tosser - Bin Your Butts' Campaign.

Due to the collaborative efforts of industry (which R&C Vic was involved) and government, the campaign succeeded in counteracting the expected increase in butt litter as a result of more smokers being outdoors.

The latest research from Community Change shows that butt litter prevention has been sustained and that licensed premises are keen to continue to avoid the negative environmental impacts from butts.

Butt littering behaviour decreased from 58% before the campaign to 33% at the campaign's peak in August last year. Further evaluation in February 2008 showed that six months after the campaign responsible behaviours are continuing with butt littering rates at just 37%.

To mark the anniversary of the "Don't be a Tosser" - Bin Your Butts campaign and to report on its success, Sustainability Victoria will be sharing the campaign's good news and results with licensed premises  and local government as well as providing additional copies of promotional materials. Our activities will include a media publicity campaign, a final mail out to licensed venues, consisting of an information sheet, posters and stickers, and an information sheet and template media release for use by local government.

Winners Accounced

The dreams of three young Victorian apprentice chefs have been realised as the winners were announced for the 2008 Thierry Marx Career Development Award at a luncheon at the Brasserrie by Philippe Mouchel today.  This years winners are:

Out of six finalists, Petros, Natalie and Kate have won a-once-in-a-lifetime opportunity to travel to France in early August for a months work experience at Thierry Marx's Chateau Cordeillan-Bages in Bordeaux.

Apprentices will receive airfares, accommodation and assistance with incidental expenses while their employers will receive an allowance to offset additional staffing costs while the apprentices are in France

It was originally intended to send only two apprentices but the judges unanimously found that all three candidates were deserving of the honour, with all receiving the maximum scores in the judging process

AIRC Award Modernisation Consultation Begins

R&C Association makes presentation in Sydney

The Australian Industrial Relations Commission began it's Award Modernisation Consultation Process in Melbourne on Monday 26th May.  Though Restaurant & Catering Victoria attended as an observer only, Restaurant & Catering Australia will be making a submission to the commission regarding the Draft List of Priority Industries (for Award Modernisation), the proposed Model Flexibility Clauses, and the Timetable for the Award Modernisation Process in Sydney on Wednesday 28th May.

The first two days of hearings in Melbourne saw some of the Major Parties make lengthy submissions to the full bench of the commission, namely: ACTU, ACCI and the AIG. 

 

Restaurant & Catering Victoria will continue to monitor the consultation process, and is actively engaged in consulting with Restaurant & Catering Australia in relation to any submissions made.

Minimum Salary increase for 457 Visa Holders

Chris Evans, announced that Minimum Salary Levels (MSLs) for temporary skilled overseas workers will increase by 3.8 per cent from 1 August 2008.

The increase is part of a package of reforms outlined in the Budget designed to improve the integrity of the temporary skilled migration (457 visa) program.

This increase will apply to new temporary skilled migrants coming to work in Australia as well as those already in the workforce who are subject to an MSL.

The 3.8 per cent increase is based on the Australian Bureau of Statistics all employees earnings increase for November 2006 - November 2007.

It increases the safety net for skilled migrant workers to help preserve their earnings power and protect them from exploitation in the workplace.'

The change will increase the current standard MSL from $41,850 to $43,440 per annum. For ICT professionals, the MSL will rise to $59,480 from $57,300.  In regional areas, the MSL will rise to $39,100 (from $37,665) and $53,530 (from $51,570) for ICT professionals.

If an industrial instrument, such as an award or agreement, prescribes a level of salary that is higher than the MSL, then this is the salary that must be paid.

The Department will directly contact employer sponsors affected by this change prior to August. The Department will also run an information campaign to inform existing visa holders of the change.

Workplace Ombudsman to target
Victorian Snowfields

The Workplace Ombudsman will be conducting an education and compliance campaign in July 2008 targeting hospitality and service industries in the Victorian Snowfields.  This has been a direct result of a considerable increase in non-compliance issues that were reported to the Workplace Ombudsman from the last snow season

The Workplace Ombudsman should have already made contact with Victorian Snowfields hospitality and service employers about the campaign and their intentions. 

Then in July, a workplace inspector will make contact with the selected employer for a full compliance audit.  The main focus of the of the audit will be ensuring that workers are paid in accordance to their minimum entitlements, time and wage records comply with the provisions of the Workplace Relations Act 1996 and applicable industrial relations instruments.

Please do not disregard this notice.  I know the timing of their audit is unfortunate and not practical, but the Workplace Ombudsman is focused on protecting and enforcing workers rights as their record shows.

Tax boss signals crackdown on cash-in-hand
business operators

The Tax Commissioner Michael D'Ascenzo has announced that the ATO will be vigorously targeting business owners that seek to avoid tax by taking illegal cash-in-hand payments are set to become a renewed target of scrutiny from the taxman.

"Cracking down on the cash economy will remain a priority for the ATO," D'Ascenzo says. "Unrecorded cash transactions are an unfair practice and have an adverse impact on the vast majority of small businesses that abide by the rules."

D'Ascenzo warns "rouge" businesses that should they chose not to reform their ways, they will be caught.  The introduction of ATO improved methods of detecting possible business breaches of tax laws will assist in their search.  He specifically points that the building and construction, hospitality, taxi, retail and transport sectors will be under the heaviest scrutiny.

Congratulations to Brandy Creek winery and View Cafe in Drouin East for winning the Tourism Winery category at the Gippsland Tourism Awards last Thursday.

 

ABS : Aussies love of Food generate big dollars
But - Industry Profits not great

Australia's cafes, restaurants and caterers generated $13.7 billion in income during 2006-07, according to figures released today by the Australian Bureau of Statistics (ABS).

The main sources of income for the 15,423 cafes, restaurants and caterers were:

  • Takings from meals consumed on the premises (47%)
  • Takings from catering services (24.1%)
  • Sale of liquor and other beverages (19.9%)

The Australian Bureau of Statistics have released their figures for this industry for the period ending June 2007.

An alarming observation that was raised was that for 2006-07, operating profit margin was 3.8% for Restaurants and Cafes. Click here for more information.

Liquor Licenses - Changes to Fees

Liquor Licensing Victoria (Consumer Affairs Victoria) has announced that on 1 July 2008, all application fees and penalties will increase, to keep in line with CPI increases.

The fees apply to new applications and renewals for liquor licences or BYO permits, for the financial year from 1 July 2008 to 30 June 2009 and are GST exempt, unless specified.

National Employment Standards (NES) Released

This week the Government released its proposed National Employment Standards (NES).

The NES are a key element of the Rudd Government's new modern workplace relations system and will come into effect on 1 January 2010.The NES will apply to all employees in the Federal system regardless of industry, occupation or income.

The NES will ensure that all employees are protected by a strong safety net of fair minimum conditions that cannot be stripped away

The NES were developed following extensive consultation and consideration of submissions from Key stakeholders (including the Association) to the exposure draft of standards which was released on 14 February 2008.

The NES provide employers with the flexibility and simplicity they need while also ensuring employees' key entitlements are protected. The NES are:

1.      Maximum weekly hours of work

2.      Request for flexible working arrangements

3.      Parental leave and related entitlements

4.      Annual leave

5.      Personal/Carer's leave and compassionate leave

6.      Community service leave

7.      Long service leave

8.      Public holidays

9.      Notice of termination and redundancy pay

10.   Fair Work Information Statement

The Government will shortly issue a revised Award Modernisation Request to the Australian Industrial Relations Commission (AIRC) attaching the NES to assist in its task of modernising awards. 

Legislation will be introduced into Parliament later this year to give effect to the Government's commitment. The legislation will include other aspects of workplace relations relating to the NES including compliance, interaction with agreement making and future reviews.

Reminder - Workplace Ombudsman to target
Victorian Snowfields

As mentioned in the last edition of e-essence, the Workplace Ombudsman will be conducting an education and compliance campaign in July 2008 targeting hospitality and service industries in the Victorian Snowfields.  This has been a direct result of a considerable increase in non-compliance issues that were reported to the Workplace Ombudsman from the last snow season.

Has this happened to you - This may be a scam?

A warning of a potential scam was recently brought to our attention by a member where a patron demanded reimbursement of the value of his lost coat after dining at their venue.  This appeared to be an authentic claim; however the staff could not recall such a coat, so suspicions were raised.  The patron insisted that the coat was lost due to the irresponsibility of staff and it was mistakenly handed to another diner.  He asserted the coat's value was over $4500 and if the venue did not "pay up", threatened to go to Consumer Affairs.

Although, there was no negligence in part of the venue, a justifiable request for proof of ownership and more importantly supporting evidence of value was asked.  The patron refused this simple request and emphasised his initial threat of going to Consumer Affairs.  After many annoying phone calls from the patron (and still could not and refused to produce evidence), the member graciously offered to reimburse that value of the meal even though they have no obligation to do so.  Despite this more than generous offer, the patron still refused and vowed to make contact to Consumer Affairs.  It is important to note that the member has not heard from the patron since.

On the surface it appears that the patron used the threat of contacting Consumer Affairs to prompt an "I'll pay so no further action" response and "bluff" his way into receiving a payment.  More importantly, the patron was also hoping for staff apathy and not challenges his claim.  This is a great example of being weary of those that unfortunately will take advantage of situations to make a buck.

Commission announces $21 per week increase in  minimum wages
Effective 1 October 2008

The Australian Fair Pay Commission announced on Tuesday its 2008 Wage-Setting Decision and delivered an increase of $21.66 per week to Australia's 1.3 million pay scale reliant workers.

The increase applies to the standard Federal Minimum Wage and to all Australian Pay and Classification Scales.

The increase will be implemented on the first pay period on or after 1st of October.

Superannuation Changes come into Force

From 1 July 2008, you must use ordinary time earnings as defined in the super guarantee law, to calculate super guarantee contributions for your employees. This ensures all employees are treated the same for super guarantee purposes. 

What are ordinary time earnings?

Ordinary time earnings are generally what your employees earn for their ordinary hours of work, including:

·            over-award payments

·            commissions

·            allowances, and

·            paid leave.

Ordinary time earnings do not include overtime (subject to certain exceptions).

Why have these changes been made?

Some employers currently pay super on an earnings base that existed before the super guarantee was introduced. This means two employees in similar circumstances may receive different super guarantee amounts. The new law standardises the earnings base to ordinary time earnings for all employees, so employees in similar circumstances receive the same super contribution.

On the Spot Fines Trial for Minor Offences

Police in Victoria will be able to issue infringement fines for seven offences including quarrelsome and offensive behaviour from 1 July.  This new trial can assist members with another tool to help deal with "hard -to-handle" patrons.

The Attorney General Rob Hulls has announced a two year trial of on the spot fines for seven offences, one of which is a person being drunk, violent or quarrelsome and refusing to leave licensed premises when requested.

Patrons can now receive a $227 on the spot fine for this offence, which will arm police with additional options for dealing with anti-social behaviour on licensed premises.

Fairness Test - We hear your concerns

Deputy Prime Minister and Director of Workplace Authority contacted

Many members have voiced their frustration and concern regarding the assessment of their AWA or Collective Agreement. With many agreements taking over 10 months to be assessed, placing significant strain on many of our members, Restaurant & Catering Victoria has engaged in communication with the Deputy Prime Minister and Minister for Education, Employment and Workplace Relations - Julia Gillard, as well as the Director of the Workplace Authority - Barbara Bennett, seeking for action to be taken to address the significant delays in the assessment process.

Restaurant & Catering Victoria, like our members, are becoming increasingly frustrated with the apparent inefficiency of the process, and will continue to push for improvements in the assessment process, as we work to alleviate this unnecessary pressure being placed on many of our members.

The charity FareShare, (formerly One Umbrella) the organisation committed providing healthy, nutritious meals to the hungry and the homeless in Victoria by using food donated by businesses is looking for a special individual to join their cause.

FareShare is seeking a professional person to manage their relationships with businesses which donate food.  The person should have organisational and managerial skills to supervise drivers; and have the judgment to assess what food can be and cannot be accepted.

Equal Employment Opportunity Amendments
Employers Required to Accommodate Parent or Carer Requests.

From 1 September important changes to the Equal Opportunity Act came into force.  They are intended, in the words of the State Government "to protect working parents and carers from discrimination when trying to balance work and family responsibilities."

These changes place an obligation to accommodate the requests for flexible working arrangements by a parent or primary carer of a child, by a person being offered a position, a current employee or a contractor.  The employer may refuse the request but only where the reason for the refusal is not unreasonable.

Some requests that the employee may make are:

  • Job Sharing;
  • Working from home;
  • Part-tim employment; or
  • Restructuring of Working hours

A number of factors are considered when determining if the refusal of a request is unreasonable, including:

  • The nature of the role (position);
  • The nature of the arrangements required to accommodate the request;
  • The financial circumstances of the employer;
  • The size and nature of the workplace and the employer's business; and
  • The effect of the workplace

It will be discrimination for an employer to contravene this requirement to accommodate the requests, which would potential lead to financial penalties for the business.

Late Entry Restrictions Trial Ends
HOWEVER - an unintended consequence of this trial may affect New Years Eve trading

The State Government's 3 month trial which prevented licensees from allowing patrons to enter their venues after 2am officially ended early this week.  The trial, which commenced on 3rd of June was part of the Brumby Government's "Alcohol Action Plan" initiative to tackle alcohol fuelled violence. 

The success or effectiveness of the trial is still yet to be quantified, R&C Vic will be preparing a submission on behalf of industry and comments or feedback from members will be vital in preparation of the submission (please submit your comments to Todd)

The trail applied to the local government areas of Port Phillip, Stonnington, Melbourne (including Docklands) and Yarra.  In addition, specific premises in Warrnambool, Ballarat, Bendigo and Traralgon were also affected. Although the trial has ended further element of the plan remains in effect.  The Minister for Consumer Affairs has directed Liquor Licensing not to grant any new late-night (post 1am) licences for 12 months from the 2 May 2008.

This means venues planning a function, on New Years Eve for example, that have previously applied for a temporary extension to their license beyond 1am will be unable to do so for NYE 2008. The Association believes this is not the intent of the temporary reforms and is working with the Director of Liquor Licensing and Department of Consumer Affairs to affect a workable solution for businesses operating in Port Phillip, Stonnington, Melbourne (including Docklands) and Yarra.

New "Intoxication" Poster

 

The 'Intoxication' poster required to
be displayed by all liquor licences and permits, has been amended.

The new poster reflects the change in the penalty for serving an intoxicated person, and allowing a drunk to remain on your premises.  The new penalty exceeds $13,000.

StreetSmart - Dine out to Help Out
The 2008 Campaign

StreetSmart Australia is once again calling for hospitality businesses to participate in their 2008 campaign; "Dine out to Help Out". 

To be held from 10th November to 24th December, 'Dine Out to Help Out" calls for restaurants to add a $2 voluntary donation to every table's bill.  Every single dollar collected will then be donated directly to support homeless refuges and charities selected based on their need and proximity to participating restaurants.

StreetSmart is looking to build on the success of 2007 where they raised over $224,000 in six weeks.  Now with a combined effort from NSW, VIC QLD and ACT and continuing support in regional Victoria like the Mornington Peninsula, Bendigo and Daylesford, this target looks to be attained quite easily.

The Association has always been a supporter and asks members to consider participating in this worthy cause.

National Hospitality Campaign Begins

 

The Workplace Ombudsman has commenced a national targeted education and compliance campaign in the hospitality industry in cooperation with the Australian Hotels Association (AHA).

Potentially affecting some of our Members, the Workplace Ombudsman will conduct targeted compliance audits from early September 2008.  An area of focus that may affect some Members include

  • Pubs, taverns and bars.

Following this educative phase, a targeted number of businesses will be selected for a compliance audit to be undertaken by a Workplace Inspector from late September to November.

Workplace Inspectors will audit compliance with employer and employee rights and obligations in relation to the issuing of pay slips and time and wages record-keeping.

They may also audit some of the following:

  • rates of pay (including casual rates and minimum rates);
  • penalty loadings (weekend, late nights);
  • allowances;
  • meal breaks;
  • juniors serving alcohol; and
  • approval and lodgement of workplace agreements.

StreetSmart - Dine out to Help Out
The 2008 Campaign

StreetSmart Australia is once again calling for hospitality businesses to participate in their 2008 campaign; "Dine out to Help Out". 

To be held from 10th November to 24th December, 'Dine Out to Help Out" calls for restaurants to add a $2 voluntary donation to every table's bill.  Every single dollar collected will then be donated directly to support homeless refuges and charities selected based on their need and proximity to participating restaurants.

StreetSmart is looking to build on the success of 2007 where they raised over $224,000 in six weeks.  Now with a combined effort from NSW, VIC QLD and ACT and continuing support in regional Victoria like the Mornington Peninsula, Bendigo and Daylesford, this target looks to be attained quite easily.

The Association has always been a supporter and asks members to consider participating in this worthy cause.

Victorian Public Holiday Changes
Melbourne Cup Day - Public Holiday across state

Changes to the Victorian Public Holidays Act have now been passed by State Parliament and it is expected that the legislation will be proclaimed to come into effect very shortly.

The changes will impact the upcoming Melbourne Cup Day.  This will be a public holiday across the entire state unless your local council has already requested an alternate day be nominated in your local government area.  Below is a list of local governments areas that have already nominated alternate days.

Local Government areas that have already nominated an alternate day are:

  • Horsham City Council
  • Mildura City Council
  • Yarriambiack Shire
  • Buloke Shire
  • City of Greater Geelong
  • Borough of Queenscliff
  • Moira Shire
  • Macedon Ranges Shire
  • City of Greater Bendigo

·         City of Ballarat

In addition the changes mean new substitution public holiday arrangements for New Year's Day and Boxing Day fall when they fall on a weekend which will be the case for Boxing Day in 2009.

When either New Years Day or Boxing Day fall on a weekend a substitute day on the following Monday will become a public holiday. However, the actual calendar days, i.e. 26 December and 1 January, will also remain as public holidays. The affect of this is to create an additional public holiday

Restaurant & Catering Victoria have vigorously opposed these changes as they will have a negative effect on many businesses in regional areas for whom Melbourne Cup Day and the Christmas New Year period are peak trading times.  Unfortunately, the Association is among a number of other industry bodies that were unable to convince the Minister that the negative economic impact on regional Victoria outweighed the benefits of greater consistency in relation to public holiday arrangements across the state.

State Wide Sales Flat

Recently released State by State turnover date from the ABS, confirms a tough period for Victorian restaurants, café's and catering businesses. The date for the years ending June 2008 shows various results around the nation.

The figures show a total nationwide turnover of $15.5 billion with growth rates ranging from 35% in the ACT to 5.5% in WA year on year. Turnover in NSW fell back to 2005/06 levels after a very large increase in 2006/07 year. 

Victoria bucked the trend and fell by 0.7% following 3 years of almost zero turnover growth, the restaurant and café sector remained the dominant part of our industry eclipsing the hotel and club sector combined by over $200 million of turnover.(Retail Trade Australia, 8501.0 2004/05 - 2007/08)

The numbers simply underline the challenges faced by many members across the state and highlight the need to regulators at all levels to exercise restraint in relation to a series of creeping legislative changes that have the potential to further increase to cost of doing business in the state

The program is designed to provide you with a nationally recognised environmental accreditation that you can use in your advertising, on your menus or to provide a point of difference between you and your competitors.

The Workshop is scheduled for Wednesday 29th October in Melbourne. You will need to attend from 9.30 - 4.30.

Paid Maternity Leave

Productivity Commission Draft Report 

The Australian Government Productivity Commission released its interim report on the development of a national paid maternity leave scheme.

 

In summary, the commission is proposing that a scheme that would:

 

  • Provide paid leave to the primary care giver (either parent) for a total period of 18 weeks and an additional amount of two weeks paid leave would be available to the other parent to be taken at the time of birth
  • Provide payments at the level of the Federal Minimum Wage (currently $543.78 per week) which would be funded by Government with benefits subject to normal taxation.
  • Specify that an employee would generally have had to have been employed for at least twelve months for a minimum of at least ten hours each week before having any entitlement to paid leave.
  • The scheme would see employers as 'paymasters' making payments to employees on leave and then obtaining a reimbursement from the government.
  • The Productivity Commission estimates the total cost of their scheme would be around $530 million each year with approximately 135,000 employees eligible. $75 million of that amount would be the cost of the super contributions borne by employers.

The Association has expressed concern in relation to several aspect of this proposal including the administrative burden of paying employees then seeking a reimbursement from government. The potential increase in payroll tax and works compensation payments and the additional burden on small business that additional superannuation payments represent.

 

The Deputy Prime Minister in comments made before the election, stated that a paid leave scheme could only be considered on the basis that it did not impose additional cost or administrative burdens on individual businesses, particularly those in the small businesses sector.

 

When taken in context with the range of IR reforms that fall into the Forward with Fairness package the Association is concerned at the cumulative impact on business of these reforms.

 

The Association is making strong representations on behalf of industry in a range of areas that will impact on total labour cost. As part of this representation the Association is highlighting to governments both state and federal the total impact on business in terms of costs, jobs, productivity and business sustainability.

NEW YEARS EVE TRADING HOURS 2008/2009

 

The Director of Liquor Licensing has announced changes to liquor licensing for NYE 2008/2009. This announcement applies to holders of General, Full Club and On-premises liquor licences, and BYO permits.

 

An automatic extension of trading hours to 1am on 1 January 2009 has been granted.

 

The Director of Liquor Licensing, after consultation with the Victoria Police, has given an automatic extension of on-premises consumption to all holders of a general licence, full club licence, on-premises licence or BYO permit.

 

Licensees can decide whether they wish to make use of the increased trading hours.

 

This automatic extension of trading does not apply to the sale of packaged liquor for consumption off the licensed premises, nor to any other type of licence.

 

Licensees must also have regard to any relevant conditions on related planning permits.

 

General, full club, on-premises licensees and BYO permittees seeking to trade BEYOND 1am on 1 January 2009, and not already holding such rights, are required to lodge an application for a temporary limited licence.

 

Licence and permit holders within the inner Melbourne area should be aware of the Government's statement of policy on the issuing of late night licences that authorise trading past 1am. This policy applies to premises within the following municipalities:

- City of Melbourne (including Docklands)

- City of Stonnington

- City of Port Phillip

- City of Yarra

 

An applicant must satisfy the Director that exceptional circumstances apply if an extension were to be granted.

 

Applications for temporary limited licences for trading past 1am in other areas will be determined on a case by case basis.

 

Applications for temporary limited licences can be made online at the following website and should be received by Wednesday, 12 November, 2008.

Award Modernisation Hearings Continue

 

On the 29th, 30th and 31st of October the Restaurant and Catering Association participated in the 3rd round of submissions for the Award Modernisation Process in Sydney.
 
The Award Modernisation Consultations will culminate in new Awards being developed for all industries, to come into effect on 1 January 2010. The Restaurant and Catering Association continues to push for a Restaurant & Catering Industry Award that is separate to those of Hotels and Motels who often have additional provisions that would increase costs for Restaurateurs and Caterers.
 
The Association is also pushing for more flexible provisions for the engagement of part-time employees, and a review of the application of Penalty Rates. A final draft of a new award(s) for the Hospitality Industry will be published by the Australian Industrial Relations Commission in December this year.

Baby Boom 

 

With a record 185,000 + babies born in Australia over the last twelve months R&C Vic has been making a contribution. Executive Council member Wylie Dalziel and his wife Leah welcomed Finley into their growing family on the 22nd of October.
 
R&C Vic training partner Managing Director Simon Philips and his wife started their family with the arrival of Georgia Grace on the 16th of October and R&C Vic Accounts Supervisor Susan Beniston and her partner Aaron and getting to know Mitchell John after his arrival on the 27th of October.

Liquor Licence Fees to Rise in 2009


Liquor licence fees will rise next year the fee rise is the first stage of a two-tiered restructure of the liquor licensing system that was outlined in Victoria's Alcohol Action Plan 2008-2013.
 
From 1 January next year all liquor licence renewal fees and some application fees will increase. The amount each fee will rise varies between application and renewal types. First-time application fees will remain the same and several new application fees have been introduced.
 
Licensees will receive their new fees in invoices due to be mailed out in mid-December and payable by 1 January next year.

Modern Hospitality Indusrty (General) Award 

 

On Dec 19, 2008 the Australian Industrial Relations Commission (AIRC) announced the new Award for the Hospitality Industry: the Hospitality Industry (General) Award.
 
The Award groups the Hotels, Motels, Catering and Restaurant Awards into one single award despite submissions by the Restaurant & Catering Association requesting a separate Restaurant & Catering Industry Award, separate from the Hotels and Motels sector.
 
The Hospitality Industry (General) Award will come into effect on 1 January 2010 and will bring with some positives and some negatives.
 
Some of the positives include: 

  • Junior rate of pay for 16 years of under - 50% of adult wage.
  • Clarification of terms regarding the service of alcohol by junior employees.
  • The ability to deduct meal costs from employee wages. 
  • Model Flexibility Clause - allows for an individual employer and employee to agree to vary certain terms of the award without disadvantaging the employee. 

The negatives of this new award include:
 

  • Increase costs for trading outside of 7am - 7pm due to the removal of the 3 hour limit for the outside 7am - 7pm allowance.
  • Increase cost of Overtime on the weekends.
  • Restrictive part-time provisions.
  • An archaic classification structure that fails to accurately represent the operations within the Restaurant & Catering Sector
  • Many clauses that have no relevance to Restaurateurs or Catering Businesses
  • Increased Complexity.
  • Little Flexibility.

Liquor Licence Fees to Rise in 2009


Liquor licence fee invoices are now being mailed out to licensees. This is a little later than usual as a result of the review of liquor licence fees. 

 

The dates for payment remain the same. Your invoice states that renewal fees are payable by 1 January 2009 but you have until 22 January 2009 to pay.
 
The change in liquor licence fees is the first stage of a two-tiered restructure of the liquor licensing system that was outlined in Victoria's Alcohol Action Plan 2008-2013.

 

Stage 2 is already underway and the Association has taken part in the first phase of consultation. As the 'terms of reference' around stage 2 become clear the Association will be making representations on behalf of industry.

Season Greetings  

Thank you so much for being an important part of your industry Association. This year has been a challenge for many with a new federal government, tough economic conditions and regulatory reform across a range of areas including major changes to Industrial Relations and Liquor licensing.
 
The Association has finished the year in a strong position with a great many changes and development which means we are well position to grow in 2009. Your support and engagement as members is invaluable, the Association is well positioned to take on the challenges and opportunities that tough economic times bring.
 
On a personal note my thanks go to the R&C Vic Executive Council, especially Ros Harvey, Gian Blundo, Matteo Pignatelli & Frank Wilden for their time, energy, patients and invaluable experience developed over many years in our industry.

Fair Work Bill 2008

Restaurant & Catering Australia is continuing to work with government in relation to the controversial Fair Work Bill - currently assisting the senate inquiry into the enabling legislation that will underpin Victoria's IR system after 1 January 2010.

The R&CA submission once again highlights the industry's dissatisfaction with being roped into an award that was created for the hotel sector, and creates an IR system that is based on the work practices of the 1970's and 1980's.

R&CA has made a number of recommendations including:
- A clear set of definitions as to the determination of union bargaining on behalf on low-paid employees
- Superannuation provisions that reflects the structure of the Superannuation Guarantee Act and set the cut in point for mandatory super payment at $450 per month
- The removal of amendments to 'late night' allowances for work completed between 7pm and 7am.


The Association nationally has committed enormous resources to the award modernisation process including economic modelling, legislative analysis, countless submissions, consultation sessions and modernisation proposals.

The next phase of the process will be guided by the senate inquiry, which will further define the likely path of the legislation through parliament.

An army of tiny, sophisticated child foodies is changing Melbourne's dining scene, reports the Herald Sun.

Personalised and multi-course menus, allergy-sensitive dining and sandpits are part of an arsenal of offerings by restaurants and cafes to lure children.

And it's food-savvy children who are often in charge of where parents spend their restaurant dollars, according to industry experts.

"The child diner is a growth industry," said Restaurant and Catering Victoria CEO Todd Blake.
"Children are becoming more sophisticated diners than in the past, and business is starting to see the importance of children in terms of their appeal.
"Often it is the four-year-old who has control of the $130 parents spend on dinner."

New editor

Trish Harty is Restaurant & Catering Victoria's new editor for Essence and e-essence.

Trish is known to many in the industry from her five years with Hospitality magazine, first as its deputy editor based in Sydney, then as editor in Melbourne.

Most recently Trish was Marketing Manager for the food and beverage operations at Crown Entertainment Complex, working with more than 40 restaurants, cafés, nightclubs, bars and snack bars.

Review of long service leave law

The Victorian Government has begun a review of the Long Service Leave Act.

Recently Restaurant & Catering Victoria participated in a consultation process commissioned by the State Government seeking to review the structure of the Long Service Leave Act 1992.

The consultation process seeks to improve the flexibility of the
legislation and address issues surrounding the accrual of long service leave for employees on an 'approved' period of unpaid leave.

As part of the consultations, the Association encouraged the provision of more flexible payment options for long service leave, and greater negotiation of the entitlements between the employer and employee.

Members are reminded that Monday 26 January is the Australia Day
Public Holiday.

No trade restrictions apply on Australia Day, so members are

free to operate as normal.

All full-time and part-time employees that would normally work this day are entitled to a paid day off without loss of pay. 

Where an employee works on the public holiday members should check their relevant industrial instrument (Award or Workplace Agreement) to ensure that your employees are being paid the appropriate entitlements.

Bushfire appeal

A big thank you to all the restaurants that participated in the Restaurant Industry Bushfire Appeal on Valentine's Day. 


This was an initiative of Restaurant & Catering Victoria in association with StreetSmart Australia, with 100% of donations to be used to help bush fire victims. An independent panel made up of community leaders and restaurant industry representatives will oversee the appeal fund's operation.

2009 Thierry Marx Career Development Award

Nominations are now open for the 2009 Thierry Marx Career Development Award. 

This prestigious award gives two young Victorian apprentices employed by members of Restaurant& Catering Victoria the opportunity to travel to Bordeaux in France. There they will work for a month under the guidance and direction of Thierry Marx - Relais Gourmand's French Chef of the Year for 2006.

ANZAC Day public holiday - Saturday 25 April


This year ANZAC Day (25 April) falls on a Saturday, and no substitute public holiday has been declared by the Victorian Government.

Therefore the public holiday applies on Saturday 25 April, along with all penalty rates and pay days off for full-time and part-time employees for whom the Saturday is an ordinary day of work.

Foster's splits wine and beer businesses

Foster's has announced it will split its Australian business into a beer business to be known as Carlton & United Breweries (CUB) and a wine business. 

Alex Stevens is the new Managing Director of CUB, bringing extensive beverage leadership experience as former CEO of PepsiCo Australia, New Zealand and the Pacific. 


The decision to split the Australian business into beer and wine is in direct response to customer feedback calling for category specialists and follows the successful introduction of dedicated wine and beer sales teams, over the past 18 months.

The new model has been designed to offer customers a greater level of service through focussed visits with greater product knowledge and channel understanding, with activities tailored to customer outlets.  

Foster's will move to its new model after Easter, to avoid any disruption during this key trading period.

Walter Wagner
 
Has over 40 years of experience in the hospitality industry and Is presently employed as Executive General Manager, Food & Beverage at Crown, Walter is responsible for the Food & Beverage Division consisting of 48 restaurant and bars, including the The Palms theatre, 2 nightclubs, 1 retail shop as well as the banqueting department, which includes the prestigious Palladium at Crown and Studio 3. He is also a member of the following organisations:

Stephen has gained International experience at the Michelin stared Frankfurter Hof Hotel in Frankfurt, the famous Dorchester Hotel in London and Jacques Reymond's Restaurant in Melbourne. He has also cooked as a guest chef throughout Australia as well as in Kuala Lumpur and Hong Kong. Stephen has been in the industry over 20 years and hopes his experience in successful businesses will be of value to the RCAV as they and our industry negotiate through the current difficult economic climate.
 
Oron Raviv
 
Oron Raviv's Catering On The Move, has grown exponentially since its inception in 2005. With over three decades experience in the hospitality industry, Oron complements his practical experience with the provision of a restaurant consulting service and New Food.com.au, a web based business showcasing the latest food products. Oron is steadfastly committed to strengthening the restaurant and catering industry so that it continues to be well poised to harness both domestic and commercial markets.
 
George Sykiotis
 
George Sykiotis has passion and foresight that has seen him establish 19 new and successful hospitality venues throughout Melbourne.  His drive and hands on approach give him the recipe to his current success.  George's always seeks to provide each and every patron an unsurpassable customer experience, whilst keeping a close eye on the financial and commercial viability of each business.  In doing so, he has been able to join forces with some of Melbourne's top chefs.  His latest venues; Tazio, The Press Club Restaurant and Bar, Maha Bar and Grill and Hellenic Republic, have been his most successful.  George's objectives are to increase the profile of the RCAV and to provide ideas and solutions to current employment difficulties the hospitality industry faces.  George believes that now is the time for the industry to unite. 

 

Roslyn Grimes-Harvey
 
I have successfully operated many small businesses in the hospitality industry over the past 30 years, including the first 8 years of Epicure Catering. My current businesses interests are The Grand Hotel Richmond and Zinc at Federation Square. For the past 4 years I have been President of the R&C Victoria and on the National Board, I have a great passion of the industry and a firmly believe in the value of R&C
 
Murphy Singh Aneja
 
Educational qualification, Bachelor of Arts, Diploma in Hospitality Management 1979. Specialisation in Hospitality management (food and beverage operations). He has been involved in the international hospitality industry for the past 28 years holding many senior managerial positions with international chain of hotels. Since 1993, owned and operated Bukhara restaurant which has won many awards; AMEX, RCAV, and has been in The Age Good food Guide and Australian Gourmet Traveler.
 
He has been a member of RCAV for over 10 years and has been on the executive council since 2008. His objectives in joining the committee are to increase the profile of RCAV, influence government policies which are beneficial for the industry as a whole, raise the profile of our profession: we should no longer be viewed by the government as a "soft target".  Murphy is also interested in addressing the shortage of skilled professionals in our industry and to increase the membership of RCAV.
 
Mark Haynes
 
Mark Haynes has been in the hospitality industry for over 30 years, with experience in both Europe and Australia.  He has headed up a number of award winning restaurants and has received the coveted Three Chefs Hat Award (The Age Good Food Guide) on a number of occasions.  He is very passionate about the industry as a whole because of what it can bring to this country from a cultural and tourism point of view.  He is on the advisory board of one of Melbourne's renowned catering colleges and is now into his 13th year as Executive Chef for all the Marriner Theatres venues, incorporating the management of the kitchens of the interstate locations.
 
Matteo Pignatelli
 
Matteo Pignatelli graduated from the 'Diploma of Business in Hospitality Management' at William Angliss in 1989, after winning individual awards for Culinary Studies, Food and Beverage Operations and Most Outstanding 2nd year Student.
                                
He has owned and operated Matteo's since 1994. Matteo's is located on North Fitzroy's Brunswick Street, and is licensed for 200. It operates 7 days a week for lunch and dinner. The restaurant has 20 full time employees and a number of casual employees. The restaurant has been awarded a minimum of 1 hat in the coveted "Age Good Food Guide" every year since 1996.
 
"This will be my second 'recession' and I believe that now more than ever we need to band together and tackle the tough times ahead". Matteos objectives in joining the committees are to address the shortage of quality industry personnel while maintaining a perspective from an employer's viewpoint with sensitivity to employee requirements in addition to increasing the profile of the RCAV so its members can collectively influence government policy to benefit our industry.
 
Leslye Thies
 
Leslye Thies, former RCV Council Member, is co-owner of Emeu Inn Restaurant, Bed & Breakfast and Wine Centre in Heathcote.  As a small business owner in regional Victoria for the last 10+ years, she has a broad interest in the hospitality industry with concerns about hiring and retaining qualified staff, training apprentices and trainees and surviving in these challenging times.  Issues around operating a small business and working in small country communities (eg access to food) are at the fore of her concerns.
 
Rod Barbey
 
Rod Barbey began cooking in 1982 and bought his first restaurant, 'Cracklins on Swan' in 1990. In 1996 Rod opened his second restaurant BCOZ, which now in it's 13th year, is Melbourne's only and longest established certified organic restaurant. Rod's philosophy at BCOZ organic dining is to embrace food that is environmentally sustainable, does not include potentially harmful chemicals and tastes the way nature intended, through a strong relationship with his local farmers, growers and suppliers. BCOZ offers a dining experience for all dining needs, with vegetarian, lactose and gluten free choices, the menu focuses on fresh seasonal ingredients.
 
Gian Blundo
 
General Manager of Ascot House Receptions, his education includes a BA Catering and Hotel Management and a Post Graduate in Marketing. Gian have been employed in hospitality industry for over 20 years and gained considerable knowledge in implementing and evaluating new business strategies, marketing, advertising, human resources and training.
 
Olivier Normandin
 
Originally from Bordeaux he became Australian in September 2008. Four years ago he opened 2 Chez Olivier's restaurants which are a reflection on his love for traditional French food accompanied by some excellent wines. Part of the committee over the last two years he would like to keep on dedicating some of his time and growing experience.
 
Frank Wilden
 
Frank Wilden has been prominent in wine and food for over 25 years. He is currently co-owner of Oyster Little Bourke and has owned many successful restaurants in Melbourne and Sydney. He is passionate about the significance of the restaurant industry's contribution to the Australian economy. Frank believes the two greatest challenges we face are maintaining tourism growth, and educating governments about our industry's needs, especially in regards to industrial relations laws and indirect taxes.
 
Richard Harper

Richard Harper is currently Senior Operations Analyst for T.G.I. Friday's Asia Pacific. This role encompasses analysis and implementation in every area of the business, including setting business metrics and measurement tools, supply negotiation, I.T./ project management and H.R./Workplace Relations. He hopes to be involved in policy direction and decision making in all these areas as part of the Executive Council.
 
Lorraine Young
 
Lorraine Young has over thirty years experience in Hospitality, ranging from Conference Management, Clubs, Restaurants and Event Management. Her strong operations and commercial background is reflected in peer recognitions over the years. In 2001 MIAA WA Branch, awarded Lorraine with networker of the years, she won catering consultant of the years WA 2001 from R&C WA and played a role in attaining the prestigious WA Golden Plate award in 2000
 
With a string food and beverage background and a wealth of experience, Lorraine is dedicated to delivering the highest quality hospitality to consumer and would like to be involved with the many issues and changes facing our industry
 
Victoria Lambie
 
Victoria qualified as a chef in, ran Gabriel Gate's Cooking school as well as producing 3 cookbooks, several television 'specials' a weekly ABC radio slot with John Fayne and GMA with Bert Newton.
 
Victoria then set up and run the Vital (Essential) Ingredient cooking school in South Melbourne. Before helping to set up Shadowfax winery with The Mansion Group, she enjoyed 6 wonderful vintages there while running the Cellar Door, Wine Club, events and Marketing. She then opened Upper House + Lower House at Fed Square as General Manager before consulting at Pam Lamaro where she remains after becoming a partner in the business.
 
Jai Anand
 
Jai Anand has more than 25 years experience as a highly successful restaurateur in the hospitality industry, owning and operating the Everest Indian Restaurant and Bar. He has a strong commitment to provide the highest quality and standard of food and beverage service and has built a strong reputation for the provision of fine Indian cuisine.  He has been an active member of Restaurant & Catering Victoria for 18 years and is also a Director of Brighton Institute of Technology.
 
John Chalker
 
From the hotel sector after 15 years, then to Chalky's in Lygon St Carlton (11 years), The Owl & The Pussycat in Exhibition St Melbourne (13 years) and one down the drain that hurt, Chalky's in the Dunes at Ocean Grove (18 months). He Very interested in industrial relations, training, finances and watching over government practices. Switch off for Earth Hour


WWF, the global conservation organisation, has called on Victorian businesses to switch off their lights for Earth Hour 2009.

As part of an international effort to send a strong message on climate change to world leaders, lights will go out at Federation Square and other famous Victorian landmarks for one hour from 8.30-9.30pm on Saturday 28 March.


Shane Wakelin, Earth Hour ambassador and former Collingwood AFL player, said he was pleased to again be supporting Earth Hour.

"Earth Hour is an Australian initiative and gives us a wonderful global opportunity to influence attitudes on climate change and the environment for many generations to come", said Mr Wakelin.

The Earth Hour campaign, which began in Sydney in 2007, has grown significantly over the past two years and now has 62 countries signed up to flick the switch in 2009.

Applications open for Fifteen

Fifteen Foundation is about to begin recruiting for its fourth group of budding apprentice chefs.

Applications are invited from young people 16-24 years old who are living in Melbourne and not in full-time education or employment. Typically applicants will have experienced homelessness, unemployment, drug or alcohol problems, been involved with the law or experienced other forms of disadvantage.

Not Modern Award


Restaurant & Catering Australia has launched a major campaign to fight the proposed so-called 'Modern Award' that would add $250 million to the industry's wage cost bill.

In a major study for the industry, KPMG Econtech estimated that the changes would cost 8,000 jobs. On average this would mean 1000 restaurants would go out of business and 50% of those left trading would be unviable.
 
"The key issue for Victorian businesses is the lack of any real modernisation of our award" says Todd Blake, CEO Restaurant & Catering Victoria.

"The limitations facing industry with regard to making enterprise level workplace agreements will negatively impact the employment flexibility that has become commonplace in the sector over recent years."
 
A new website www.notmodernaward.com has been launched to provide information on current advocacy activates and give members tools to inform their local Member of Parliament that the proposed 'Modern' award is not acceptable for our industry.

WorkSafe targets restaurants and cafés


WorkSafe has advised cafés and restaurants in Fitzroy, Collingwood and St Kilda that it is rolling out an inspection campaign over April and May.

The inspection campaign is being run nationally and intended to help employers provide safer workplaces and better understand their obligations to new and young workers who are a major part of the hospitality sector.

The campaign is also designed to increase the awareness of new workers and those under 25 about their workplace health and safety rights and responsibilities.

Tourism Industry support for bushfire victims


The Australian and Victorian Governments have jointly funded a $10 million Tourism Industry Support Package, aimed at getting tourists back to Victoria's regions economically affected by the bushfires. 

The regions affected include Victoria's High Country, Gippsland and the Yarra Valley and Dandenong Ranges.
 
The Victorian Bushfire Tourism Industry Support Package will provide:
· $6 million towards a cooperative marketing and brand rebuilding program to promote visitation to economically-affected areas
· $1 million to bring forward postponed events and marketing of existing events
· $3 million to assist with the enhancement and redevelopment of tourism and visitor facility infrastructure in national, state and regional parks adjoining bushfire affected areas.

The package will be developed in close consultation with Tourism Victoria, Parks Victoria and tourism operators in response to industry need and will be funded between March 2009 and June 2011. Funds will be rolled out through the Regional Response and Recovery Committees and the State-wide Response and Recovery Committee.

Last Tuesday saw the R&C Vic AGM take place at The Wine House in South Melbourne. Strong 2008 results were reported with about 50 members attending the event.

 

Stage two of the Council election cycle has now been completed with the Association's office holders confirmed for 2009. Congratulations to:

Marketing opportunity for city restaurants


City of Melbourne is preparing for its 'Winter in the City' marketing campaign which takes place from 1 June - 31 August.

In particular, the campaign will highlight the range of dining promotions happening across the city in conjunction with major events, as well as ongoing winter dining activities.

Opportunities for city restaurants and cafes include:
· PR campaign opportunities
· Inclusion in Winter Hot Spots magazine
· Promotion details added to website business listings
· Channel 7 TV special - to air in early July.

Restaurants and cafés in the City of Melbourne who wish to participate must contact Jo Pearson by tomorrow Friday 3 April. You will need to provide details of your winter dining promotion or event activity, with 2-3 images.

Easter
The following days have been designated Public Holidays:

10 April - Good Friday
11 April - Easter Saturday
13 April - Easter Monday

ANZAC Day
This year ANZAC Day (25 April) falls on a Saturday, and no substitute public holiday has been declared by the Victorian Government.

Therefore the public holiday applies on Saturday 25 April, along with all penalty rates and pay days off for full-time and part-time employees for whom the Saturday is an ordinary day of work.

Government announces changes to 457 visas


The Federal Government has announced changes to the Subclass 457 visa program, the uncapped temporary visa program driven by employer demand for skills that are not available locally.

The seven changes are:
1) The indexation of the minimum salary level for all new and existing 457 visa holders by 4.1% on 1 July 2009.

2) The implementation of a market based minimum salary for all new and existing 457 visa holders from mid September 2009.
 
3) Increasing the existing minimum language requirement from 4.5 IELTS to 5 IELTS for 457 visa applicants in trade occupations and chefs.

4) Progressively introducing formal skills assessment from 1 July 2009 for 457 visa applicants from high risk immigration countries in trade occupations and chefs. 

5) Introducing a requirement that employers seeking access to the 457 visa program have a strong record of, or demonstrated commitment to, employing local labour and non-discriminatory employment practices.

6) The development of training benchmarks to clarify the existing requirement on employers to demonstrate a commitment to training local labour.

7) The extension of the labour agreement pathway to all ASCO 5 - 7 occupations, to ensure that employers using the 457 visa program to access these occupations satisfy obligations on local training and employment.

The Government will be considering further measures in the context of the 2009 Budget.

In the first three months of 2009 there were an average of 430 primary visa applications a week lodged by people offshore, down from 700 a week in the six months to December 2008. The Government believes shows that the program is responding to the changing economic circumstances.

Last week for applications at Fifteen


Budding chefs have a week left to apply for the Fifteen Foundation's fourth intake of apprentices.

This is a fantastic opportunity for disadvantaged young people to gain a chef apprenticeship in a supportive learning environment.

Applications are invited from young people 16-24 years old who are living in Melbourne and not in full-time education or employment. Typically applicants will have experienced homelessness, unemployment, drug or alcohol problems, been involved with the law or experienced other forms of disadvantage.

SecondBite assists bushfire victims


SecondBite was quick to assist the victims of the Black Saturday fires in February, with a record amount of food donated and distributed.

By the beginning of the week SecondBite volunteers were delivering essential supplies of food and drink to residents of Wittelsea and Kinglake.

"The Kinglake residents had been isolated and were unaware of the enormous public awareness and support so when we arrived they were noticeable moved by the selection of supplies that were being delivered," says Katy Barfield, Executive Director of SecondBite.

SecondBite has continued collections and deliveries of fresh produce to the communities affected by the fires ever since, bringing the total to approximately 42 tonnes, enough food to provide 84,000 hearty meals.  

"This is an unprecedented event and understandably we had no budget prepared for this relief and therefore would appreciate any support that will enable us to continue to support bushfire affected communities for as long as is needed;" says Katy, adding that costs so far have exceeded $15,000.
